What you can buy under the moratorium and what to check on the licence
- Málaga city grants no new licences: municipal moratorium since August 2025 (up to 3 years) and an 8% cap on holiday homes per neighbourhood, upheld by the TSJA in February 2026. A valid licence is a scarce asset: check it in the Andalusian Tourism Register before buying.
- Community of owners: since April 2025, new holiday homes need the approval of 3/5 of the community.
- VAT: Royal Decree-Law 29/2026 applies 10% to stays of up to 30 nights from 1 December 2026, if ratified (vote expected on 12 November).
- Alternatives without a licence: mid-term rentals with a stated reason (32 days to 12 months) or room-by-room letting, each with its own rules.

Investor FAQ
Can you buy a holiday rental flat in Málaga city today?
Only with a licence that is already valid: the City Council grants no new licences because of the moratorium since August 2025 (up to 3 years) and the 8% cap per neighbourhood. Before buying, check the licence in the Andalusian Tourism Register.
What net return can I expect?
Across the homes we analysed, the median is 6.6% net on today’s market price, compared with 4.3% for a long-term let of those same homes. It depends a lot on property type and area.
What should I check on the licence?
That it is registered and valid in the Andalusian Tourism Register, that it matches the property (address and capacity) and whether the community of owners has passed any resolution: since April 2025 new holiday homes need 3/5 approval.
How does the 10% VAT affect returns?
Royal Decree-Law 29/2026 applies 10% VAT to stays of up to 30 nights from 1 December 2026, if ratified (vote expected on 12 November). We include it in every study.
What if the property has no licence?
There are alternatives with their own rules: mid-term rentals with a stated reason (32 days to 12 months) or room-by-room letting. We show you with data which one pays off.
How does leasing to Nordik work?
Nordik leases the property and the owner invoices Nordik a rent of 50% of gross revenue. Nordik covers platforms, cleaning and laundry; the owner only maintenance and investments. Check the tax implications (VAT and income tax withholding) with your tax adviser.
